Terms of Service
This is Qaiku's Terms of Service (TOS). Please read it through so you know what you can wait from us and what we wait from you. So let's get to know each others first. We are Qaiku and in TOS we also go with the names 'We', 'Service' and 'Service provider'. And You – in TOS we are calling You with a name... 'You' :)

By creating a Qaiku user account, publishing any content in the Service or copying any content from the Service You agree to be bound by the Terms of Service. In other words using the Service at any way will be treated as acceptance of the TOS sheet.

You use the Service at your own risk. If something unpleasant should happen to you or to anyone else because of the use of the Service, you agree that the Service is not responsible for ANY kind of direct or indirect or consequently losses. By ANY we mean, but are not limiting to, any loss of profit, goodwill, business, reputation or data. All this is very highly unlikely, but we must say this aloud and You have to understand what this section is all about. This said, we take very seriously all the possible harm caused to users and we constantly do our best to prevent any inconveniences.

You guarantee that any personal information you are asked to provide by the Service will be correct and accurate. We need the information to keep you posted about the changes in the Service, to be able to solve possible problems and to prevent unwanted spammy user accounts. We promise to protect all the information the best way we can and we won't give any of Your information to any third party without your permisisson.

The Service is offered free of charge. We reserve the right to change the Service or some part of it to be chargeable. That said it's very unlikely that the whole Service would be chargeable so You should not worry too much about this.

You are solely responsible for any possible connection and other fees genereted when using Qaiku. Please note that if you for example use the service by mobile your mobile network operator will most likely charge you for all the data traffic you create using the Service. In other words don't come to knock on our door if you should go to a roadtrip and qaiku from mobile like it's -99 again and you should receive a huge phone bill later on..

The service is provided to you "as is" and we don't give you ANY kind of guarantee with respect to it or its continuation. We know, we know, this sounds a bit harsh as we develop Qaiku with love and we will always do our best to make the Service run as smooth as possible and would never should it down without a very good reason, but if we should fail to do this from time to time, you aknowledge and agree that bitching about it is neither cool or justified.

Everything and anything in the Service might change overnight.
As we are constantly developing new stuff to make the Service better, you aknowledge and agree that any functionality can be added, altered or removed without a prior warning. You understand that changes can bring surprising technical problems that might require some time to get fixed. That said, we aim to be able to give you a good heads up regarding bigger shifts.

We reserve the right to reclaim or remove channels and usernames and to constrain the use of the Service from anyone for any reason at any time and to remove or modify any content for any reason at any time without a prior notice. remove or modify any content for any reason at any time without a prior notice. We don't reserve this right to be mean, but to make sure that the Service will work as intented and within the boundaries of the Finnish law and to protect the rights and the convenience of the users of Qaiku. We hope that we don't ever have to apply this section to you, so please read the next sections with extra care.

Be nice.
You agree not to use the Service for anything bad, evil, illegal, things against TOS, bad mannered behaviour or any other use that could lead to a unreasonable harm to yourself, those around you, to the Service or to anyone at all. In other words We expect also You and other Qaiku users to have good manners. Please note that there are several communities and channels that have their own unique norms and behavioural code – remember to respect also these.

Don't spam, period. Qaiku is not meant for spamming like a madman. By spam we mean aggressive advertisement-like behaviour as for example sending repetiteve content with links to external sites without a real engaging and interacion with the user community of Qaiku. The same goes with the creation of channels and reserving numerous different channel names; creating a channel means that activity in that very channel is required. We will close any accounts conflicting with this rule without a grief.

Users have power in Qaiku. When you participate in discussion that you have not started yourself, you are in practice publishing content in a discussion thread that is linked to some other user's user account or in Channel that is administrated by some other user. You notice that these users might have a possibility and right to remove your content added to their discussion thread or to their channel. Also You can find yourself in a situation where you are able to remove content created by other users. Please, use this power with a great consideration and wisdom.

You are what you do. You aknowledge and agree that you are solely rensponsible for all the activity and content that takes place under your screen name and account. Because of this, remember to keep your password secure and your behaviour nice. We may close accounts that are interpret as troublemakers or as highjacked.

Others are what they do as well. You understand that all the information in the Service (such as text, images, links, graphics, logos etc.) are sole responsibility of the person, community or company from which such content has originated. In other words We are not as a Servce provide in ANY way responsible if some user of the Service is violating your copyright or your honor. This said, we will take action in any ill-mannered behaviour as stated in section 8 and 9.

What is yours is yours. If you own the rights to the content you create or add to the Service, you will naturally own them in the future as well. Please notice though that by submitting content to the Service you agree to grant us an unlimited permission to use that content in the context of the Service or in the context of promoting the Service. In practice this means that we can use user generated content to promote Qaiku and to demonstrate its featuring when marketing the Service to new users and to possible new business partners. In other words We won't sell your pictures to a mousepad manufaturer or your poems to a book publisher, but the content you have created might show up in presentation materials, in articles about Qaiku or in similiar cases. And of course, what is private is private; we will not use in any context any content labeled as private data.

What is not yours is not yours. You are solely responsible for any content you add to the Service and you aknowledge that adding content that is protected by the copyright or any other law is not allowed. As it is, You understand that all the content found in the Service may be protected by intellectual property rights which are owned by the person or company from that content has originated. We also reserve the right to reclaim channels and usernames and such on behalf of businesses or individuals that hold legal claim or trademark on those channel names or usernames or such.

Qaiku takes no responsible of the user generated content in the Service or the linked content found elsewhere in the internet. As the Service may contain for example files shared by users and hyperlinks to other web sites, content and resources etc, you aknowledge and agree that the Service does not have any control or responsibility over these contents shared by users or external web sites or resources. That said, We do our best to keep harmful and illeagal content and links away from Qaiku, but We urge You to use your own common sense as well.

Do not hack (if you are not asked to). Hacking of the Service isn't cool and also not allowed without a univocal permission from the Service provider. You agree that you will not try to access the service by any other way than official interfaces or APIs provided by us. You also agree not to do anything that could interfere with or distrupt the Service or the servers and networks that are connected to service. That said, it's more than wonderful if you are interested on developing services and external features around Qaiku. Please remember that the safest road is to ask first through the feedback form though.

This TOS is governed by Finnish law and You and We as a service provider agree to submit to the jurisdiction of the courts of Finland to resolve any legal matter that might be arising from the Terms of Service or from the use of Service. Regardless of this you agree that we as a Service provider are still allowed to apply for justice and remedies in any jurisdiction we choose. If any court of law that have the jurisdiction to decide on this matter, rules that any provision of these Terms of Service is invalid, then that provision will be ruled under the Finnish law without affect to the rest of the TOS. Basicly that means that the remaining provisions of the Terms of Service will continue to be valid.

We reserve the right to make changes to the Terms or Service and other rules without a prior notice. When bigger changes are made to TOS, we will make a new copy of the Terms of Service available at this page and notify about the changes on the frontpage of the Service and on the #Qaiku -channel. If the changes are minor it's possible that the changes are notified only on the #Qaiku-channel. You aknowledge and agree that if you contiune to use the Service after the date on which the Terms of Service have changed, it will be treated as an acceptance of the updated TOS.

You can terminate your legal agreement and close Your account at any time. Closing the user account means that all the personal information tied to that account will be removed by Qaiku. However all the content the user have not removed themself will stay on the Service. You can close your account for example by notifying us through the feedback form.
If one should act against any provision of the TOS or its spirit or indulge in any other ill-mannered behaviour (especially if repetitive), their account and all their content might be deleted without a prior warning.
